Geico - The Lizard, the Winch and the Warlock

Last week my car was hit by a vehicle insured with Geico (The Lizard).

My Car was taken to a Geico Claims Adjustment Site (The Winch).

There, I was greeted by a Claims Adjuster (The Warlock).


New York Insurance Bill A08494 states the following:

"...only new original equipment manufacturer (OEM) replacement crash parts may be used on any vehicle during the year of manufacture and for two succeeding years..."

So explain to me why when my, 2006 Honda Accord EX V6 with 9839 Miles on it, was damaged and I ever so kindly took it the see a Geico Claims Adjuster, I received the following repair estimate, riddled with Parts from Mexico and "Competitive Replacement Parts". According to my window sticker My Honda is comprised of US/Canadian Parts and Japanese parts.

TITLE OF BILL A08494:  An act to amend the vehicle and traffic law and the insurance law, in relation to requiring types of replacement crash parts used in automobile collision repairs be disclosed to vehicle owners and written authorization to use specified parts be obtained prior to installation.

"This bill would require the use or installation of OEM parts on all vehicles during the year of manufacture and for two years thereafter, or the duration of the vehicle's warranty, whichever is longer. No insurance company may require the use of imitation or salvage parts when negotiating repairs on such a vehicle with any repairer."

{this bill} Amends section 3411 of the insurance law by adding a new subdivision(o) to prohibit insurers from directly or indirectly requiring the useor installation of any type of replacement crash part for the repairof a collision damaged vehicle without disclosing the type ofreplacement part to the owner of the vehicle. In addition, provides that only new original equipment manufacturer (OEM) replacement crashparts may be used on any vehicle during the year of manufacture andfor two succeeding years thereafter, or the duration of the warranty,whichever is longer. In the event non-OEM parts are used or installed,and such parts are ill-fitting or require additional labor ormaterials in their installation or use, the insurer shall beresponsible for the cost of such additional labor and materials.
